To use Wishy, you must create an account by providing:

• A display name (username)

Alternatively, you may sign up using Google Sign-In.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

3.3 Account Security

You agree to:

• Choose a strong, unique password
• Not share your password with others
• Log out after each session on shared devices
• Enable two-factor authentication if available

4. Acceptable Use Policy

4.1 Permitted Use

You may use Wishy to:

• Create and manage personal wishlists
• Add products and wishes to your lists
• Connect with friends and share wishlists
• View and reserve items in friends' wishlists
• Customize your profile and app settings

4.2 Prohibited Conduct

You agree NOT to:

• ❌ Infringe on intellectual property rights
• ❌ Harass, bully, or threaten other users
• ❌ Post offensive, hateful, or discriminatory content
• ❌ Impersonate another person or entity
• ❌ Spam or send unsolicited messages

• ❌ Attempt to hack or gain unauthorized access
• ❌ Scrape, crawl, or data mine the Service
• ❌ Use the Service for commercial purposes without permission
• ❌ Create multiple accounts to abuse features
• ❌ Interfere with the proper functioning of the Service

5. User Content

5.1 Your Content

"User Content" means any information, data, text, images, or other materials you submit, post, or transmit through Wishy, including:

• Wishlist titles and descriptions
• Product names, prices, and notes
• Profile information and avatars
• Contact messages

5.2 Content Ownership

You retain ownership of your User Content. By submitting content to Wishy, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store and process your content to provide the Service
• Display your content to friends (based on privacy settings)
• Create backups and ensure service continuity

This license ends when you delete your content or account.

5.3 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the right to use all content you submit
• Your content does not violate any laws or third-party rights
• Your content is accurate and not misleading
• Your content does not contain malware or harmful code

5.4 Content Moderation

We reserve the right to:

• Review User Content for compliance with these Terms
• Remove content that violates these Terms
• Suspend or terminate accounts for violations

However, we are not obligated to monitor all User Content.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Wishy, you consent to:

• The collection and use of your data as described in the Privacy Policy
• Storage of your data on Google Firebase servers
• International data transfers as necessary to provide the Service

7. Intellectual Property Rights

7.1 Our Rights

Wishy and all related materials, including but not limited to:

• App design, layout, and graphics
• Software code and architecture
• Logos, trademarks, and branding
• Documentation and content

are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the App for personal, non-commercial purposes
• Access and use the Service in accordance with these Terms

This license does not permit you to:

• Modify, reverse engineer, or decompile the App
• Copy or distribute the App
• Remove or alter any proprietary notices

8. Third-Party Services

Wishy integrates with third-party services:

• Google Firebase: Backend infrastructure and authentication
• Google Sign-In: Optional authentication method

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for third-party services or their content.

9. Disclaimers and Limitations

9.1 "AS IS" Service

9.2 No Liability for User Content

We are not responsible for:

• User Content posted by you or other users
• Accuracy, reliability, or legality of User Content
• Disputes between users
• Losses resulting from reliance on User Content

9.3 Service Availability

We strive to keep Wishy available 24/7, but we do not guarantee continuous availability. We may:

• Suspend the Service for maintenance
• Modify or discontinue features
• Temporarily restrict access

We are not liable for any loss or damage resulting from Service unavailability.

You agree to indemnify, defend, and hold harmless Wishy, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service

• Your User Content

12. Account Termination

12.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in Settings → Profile
• Contacting us through the Contact Form in the Wishy app (Settings → About)

Upon termination, your account and all data will be permanently deleted within 30 days.

12.2 Termination by Us

We may suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Illegal or harmful conduct
• Suspected fraud or security threats
• Prolonged inactivity
• Any reason at our sole discretion

12.3 Effect of Termination

Upon account termination:

• Your license to use the Service ends immediately
• Your User Content may be deleted
• You remain liable for any outstanding obligations
• Provisions that should survive termination will continue to apply

13. Changes to the Service

We reserve the right to:

• Modify or discontinue any feature of Wishy
• Change pricing for future premium features
• Update the App's functionality
• Impose usage limits

We will make reasonable efforts to notify you of significant changes.

We may update these Terms from time to time. When we do:

• We will update the "Last Updated" date
• We will notify you through the App or email
• Significant changes will require your acceptance

Your continued use of Wishy after changes constitutes acceptance of the new Terms.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a legal claim, you agree to contact us through the Contact Form in the Wishy app (Settings → About) to resolve the dispute informally. We will work with you in good faith to reach a resolution.

15.2 Governing Law

These Terms are governed by the laws of the European Union and applicable member state laws, without regard to conflict of law principles.

15.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits.

16. General Provisions

16.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Wishy regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

16.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

16.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or technical failures.
